Our Family and Divorce Law Firm’s Primary Practice Areas

At Twyford Law Office, we are well-versed and experienced in all areas of family law. Some of the primary practice areas our attorneys handle include:

Divorce is also known as the dissolution of marriage. It is the legal process for ending a marriage in Washington State. You remain married until a judge signs a final divorce decree that is filed with the court. Divorce settles many issues, including property division, child custody, child support, and spousal support.

Child Custody

The primary concern when deciding child custody cases is the best interests of the child. Washington family courts prefer parents to negotiate a parenting agreement and timeshare schedule that encourages and facilitates a close relationship between the child and each parent.

Therefore, joint custody is generally performed, but the court will grant sole custody when joint custody is not in a child’s best interest.

Child Support

Even though parents are not married or no longer reside in the same house, they continue to have a duty to provide for their children’s basic needs. Washington uses standard child support guidelines to determine the support obligation. Each parent is expected to pay their share of the support obligation.

Judgment Modification

Life events and circumstances may require modification of orders related to child support, custody, or alimony. A party can petition the court for modification of an existing order.

However, the court will not change the current order without justification. Therefore, the petitioning party must prove a substantial change in circumstances warrants the modifying of the order.

Property Division

Couples accumulate property and assets during the marriage. Most property acquired during a marriage is subject to property division during a divorce. Spouses can negotiate a property settlement agreement to divide marital assets and debts. The court decides for them if they cannot agree to property division terms.

How Do I Seek a Divorce in Spokane?

Washington divorce laws require that at least one spouse is a state resident or be stationed in Washington as a member of the armed services to file for divorce. There is not a specific period you need to live in Washington to file divorce papers.

Since Washington is a no-fault divorce state, you do not need to prove that your spouse’s conduct caused the breakup of your marriage. Instead, either spouse can file for a divorce based on the grounds of “irreconcilable differences.” The petitioning spouse asserts that the marriage is irretrievably broken. The divorce can be granted even though the other spouse does not want to end the marriage.

There is a 91-day waiting period after filing for divorce before the court will enter a divorce decree. However, divorces can take longer when spouses disagree on one or more issues. Our Peaceful Valley divorce lawyers work with you to obtain your divorce as soon as possible with terms that are in your best interest.

How Will My Property Be Divided in a Peaceful Valley DIvorce?

Washington is a community property state. Therefore, each spouse owns a 50% share of marital assets. However, a prenuptial or postnuptial agreement could change that presumption.

Marital assets are subject to property division during a divorce. If you and your spouse fail to negotiate a property settlement, the judge decides how to divide marital assets and debts. Factors the judge may consider in property division cases include:

  • How long the spouses were married
  • The financial situation of each spouse
  • The extent and nature of the couple’s community property
  • The extent and nature of each spouse’s separate property

Our Peaceful Valley property division lawyers work with you to obtain a fair share of the marital assets. We have experience with complex issues related to property division, including hidden assets, high-asset divorces, liquidation of marital assets, and business valuations.

Who Will Get Custody of Our Children After the Divorce?

The primary concern during a child custody case is the best interests of the child. If parents can agree to custody terms that are in their children’s best interests, the court should incorporate the parenting plan and visitation schedule into the final divorce order.

However, when custody is in dispute, the judge must determine what is in the child’s best interest. Judges consider numerous factors, such as:

  • A parent’s work schedule
  • The child’s emotional and developmental needs
  • The wishes of the parents and the children
  • A child’s involvement in their community, school, and extracurricular activities
  • A parent’s past performance in caring for their child
  • The potential for future performance in child-rearing
  • A child’s relationship with their siblings and other adults in the home and their life
  • The stability and safety of the home

The court also considers allegations of parental alienation, child abuse, and domestic violence. Accusations that a parent is unfit are also investigated thoroughly.

Our Peaceful Valley child custody lawyers strongly advocate for you and your children. We fight to ensure that you retain your parental rights and your child is protected throughout the divorce proceeding and into the future.
